Warranty Terms and Conditions

Each TheraLight 360 and TheraLight 360i unit is warrantied to be free from defects in workmanship and materials for the period of five (5) years from the date of delivery and under normal use and service.

Each TheraLight FIT unit is warrantied to be free from defects in workmanship and materials for the period of three (3) years from the date of delivery and under normal use and service.

In the event that the light emitting diodes (LED) fail, this warranty covers the replacement of each diode for the life of your any of your TheraLight units (TheraLight 360, 360i, or TheraLight FIT). This is a lifetime coverage so your LEDs are covered for as long as you own the unit.

TheraLight’s duty under this warranty is limited to providing any and all necessary product
repairs upon TheraLight examination and final determination as to cause or existence of defect
and, at its option to repair or replace the products, which prove to be defective during the
warranty period.

This warranty extends only to the original end-user purchaser (including authorized distributors)
of the TheraLight product.

Any transfer of warranty must be approved in writing by TheraLight. Warranty transfers will
require review and recertification by the company. The Warranty is transferable for the remaining
time portion of the unit and upon written request and approval

Products replaced under warranty will be warranted only for the balance of the warranty time
period from the original supplied TheraLight product.

The Standard Warranty will not apply to those products which have been:
a) repaired or altered other than in accordance with the terms of this Agreement
b) abused, misused, improper handling in use, or storage, or used in an unauthorized or
improper manner or without following written procedures supplied by the company.
c) original identification markings or labels have been removed, defaced or altered,
d) any other claims not arising directly from material defects in material or workmanship.

This Standard Warranty is the exclusive warranty made by TheraLight is in lieu of all other
warranties, whether written, oral, or implied, including any warranty of merchantability or fitness
for a particular purpose, and shall be purchaser’s sole remedy and TheraLight sole liability on
contract or warranty of otherwise for the products. This warranty shall not be modified or
amended without the written approval of TheraLight.

This warranty does not cover cosmetic wear or cleaning, intentional or accidental damage by the owner, or the replacement of stolen parts.

Product returns are not authorized by TheraLight, and any product return requests are evaluated on a case by case basis. Any product return is subject to a 25% restocking fee. Bed removal and freight shipping are not included and will be added to the restocking fee. TheraLight will not accept product returns (or refunds) after ninety (90) days from the date of
original purchase.

All products shipped to the company must have prior approval. The Company will not honor any unauthorized returns. Any damage from the unauthorized return will become the sole financial responsibility of the customer.

If an order cancellation is made while the shipment is in progress, freight fees will be non-
refundable.

In no event shall TheraLight be liable for any indirect, special, incidental or consequential
damages resulting from the failure to perform or use or improper use of any goods or services
sold pursuant hereto, whether due to breach of contract, breach of warranty, negligence or
otherwise.
